California Supreme Court Accepts Certified Question in Prop 8 Appeal

As reflected in the order appended to its news release here, the California supreme court yesterday agreed to decide the question of state law that the Ninth Circuit panel in the Prop 8 appeal had certified to it—namely, whether under California law “the official proponents of an initiative measure possess either a particularized interest in the initiative’s validity or the authority to assert the State’s interest in the initiative’s validity, which would enable them to defend the constitutionality of the initiative upon its adoption or appeal a judgment invalidating the initiative, when the public officials charged with that duty refuse to do so.” As the Ninth Circuit panel explained in its order, that question of state law bears directly on Prop 8 proponents’ Article III standing to appeal Judge Vaughn … Read entire article »

Does This Mean DOMA Is Doomed?

Ed Whelan is right as usual in his post about the Obama administration's decision to stop defending (sic) the Defense of Marriage Act in court, especially when he writes that this decision ends what was only a charade to begin with. The Obama Justice Department was already torpedoing DOMA by making fallacious arguments in its behalf. DOMA is better off without this kind of help. That Attorney General Holder claims the administration will nonetheless "enforce" this supposedly indefensible law is really quite a puzzle. Ed Whelan sees politics in all this, as well he should. But even politicians would blanch at maintaining what Holder is poised to attempt. The attorney general has sworn an oath to protect and uphold the Constitution. New Jersey Senate Does Governor Christie a Favor

According to the AP, the New Jersey Senate “is scheduled to vote Thursday on a resolution saying Justice Roberto Rivera-Soto should resign [from the New Jersey Supreme Court] if the Assembly doesn’t move to impeach him.” The vote is supposed to be a rebuke of Governor Christie, who has not played along with Senate President Stephen Sweeney’s ongoing attempt to control the state’s supreme court. But constitutional conservatives weren’t too thrilled with Rivera-Soto’s judicial record anyway, so I’m not sure this is such a smart move. If Rivera-Soto resigns or is impeached it would actually end up benefiting Governor Christie by giving him another appointment and hastening the fulfillment of his campaign promise to remake the court.
