    do us a favor and explain for everybody how we got money in politics defined as free speech and how the Supreme Court made a number of decisions which got us to where we are now I’m glad you asked okay so early 70s Watergate happens uh and before Watergate there was a sort of a set of scandals uh that put on the books the first campaign Finance law uh in the modern era there hadn’t been a major anti-corruption law uh on the books legislated for probably about 50 years into the early 70s anti-corruption laws were not being enforced uh the uh expense of running for office had exploded because of the TV era they pass this uh original federal election campaign act uh in part Nixon has this Scandal where he’s raising money from the Dairy Producers be uh in exchange for essentially raising the price of dairy products in America uh Nixon sign it okay I guess we’ve cleaned up our corruption problem not so fast Nixon suddenly is um trying to circumvent his own law sort of the first dark money Scandal uh of the modern era AKA Watergate people remember the break-in but it was actually the first dark money scandal in the in the sense that Anonymous uh uh undisclosed illegal campaign donations from major corporations ended up funding in part the Watergate Breakin those corporations get prosecuted uh there’s another set of anti-corruption laws campaign Finance laws the post-watergate reforms they’re pretty well known uh okay we’ve cleaned up the system right hey yay we did it we finally have a civilized uh Clean Campaign Finance system to get money out of politics not so fast because what was happening at the same time was that corporate forces at this time were looking at a government that had become very small D democratically responsive I mean this is the era of Medicare Medicaid uh civil rights laws the voting rights laws EPA Clean Air Act Clean Water Act uh the war on poverty Lewis Powell at that point a tobacco industry lawyer head of the American Bar Association imagined sort of like Pinnacle of the establishment writes this memo uh saying corporations are effectively under attack uh the uh government has become effectively too democratically responsive uh and it’s killing free enterprise it’s killing big business it’s kind of hilarious to think about think about somebody writing this down but this thing goes viral he writes it for the Chamber of Commerce there’s a ton of organizing going on this is as the Watergate scandal is unfolding a sort of underground corporate organizing to fight back they end up slipping in to that post-watergate campaign Finance reform uh loopholes that allow for the explosion of corporate packs uh they also launch a legal movement uh a series of legal groups for inance the Pacific Legal Foundation is one of many to try to mimic what Ralph nater was doing at the time which was bringing specific cases to the courts in order to try to elicit specific rulings and they have a focus on campaign Finance so when those water post-watergate reforms uh are passed very soon after I’m talking about like days or weeks after uh they go into court trying to strike down basically all of the camp the campaign Finance law this is the famous Buckley V valo Case masterminded by I’m not making this up John Bolton yes the same John Bolton wow this was his idea a then Fring for Gump of evil yes right yeah yes shows that he’s always there right and by the way we we we have a fun on on the podcast uh where there’s like a master plan Cinematic Universe of of these people who like keep popping up it’s like John Bolton Robert bour I mean these people just keep popping up long story short they secure ruling then and get the Supreme Court to enshrine what was then a radical idea that money in politics is not corruption money in politics is constitutionally protected Free Speech this is the building block of everything that comes after and one of the first things that comes after this soon after this is another court case and now Lewis Powell the guy who wrote that memo has been installed on on the Supreme Court Lewis Powell very soon after the Buckley case Works behind the scenes at the Supreme Court and we have the documents to prove it to take a relatively obscure Massachusetts case and use it to extend those Free Speech rights to corporations when they spend in elections and that ruling called the bot ruling becomes the basis of the citizens united ruling quite literally if you go look at the citizens United ruling you can search for the word Botti you will see it in there because that ruling where Lewis Powell the author of the pow memo worked behind the scenes to execute in part the memo and the the plan that he had put put forward and he had outlined I’m I’m currently uh trying to look it up my memory is failing me but I remember from our friend Tom Hartman uh there was a law in the US that I believe had fully banned corporate spending politics at one point yes also the uh the corporate death penalty was like a regular occurrence back in the day the idea was that if you can’t prove that your business is beneficial for the community right the state has every right to be like you’re done there was a completely different conception of what a corporation should be and now as you described David we’ve flipped all of that and now all the powers with the corporations and not with the government the government serves the corporations and I didn’t did not know that fact about John Bolton that he was the one who came up with that argument I had no idea and just so everybody remembers John Bolton is the neocon neocon who never met a war he didn’t like he was a leader in getting us into the Iraq War he wants to go to war with Iran he’s the guy who said when Trump was negotiating with Kim Jong-un in North Korea he’s the guy who went to the press and said we’re looking at doing the Libya model with North Korea which means it’s a threat we’re going to overthrow these people this guy is behind every horrible thing that’s happened in this country yeah and and look look he he saw I mean talk about at that point he thought it was a glitch in The Matrix he saw a way to do this and he worked with a guy named Ralph winter uh who became a federal judge uh and of course Senator James Buckley and but and and it is interesting to think about the butterfly flapping its wings and in that in the episode about Buckley Vio the I mean in a sense the assassination of Robert Kennedy leads right to this Robert Kennedy is assassinated uh they put in a a replace m a republican uh replacement for Kennedy because the governor of New York was Republican uh and the uh replacement uh became an enemy of Richard Nixon because this replacement Charles Goodell uh was opposed to the Vietnam War and so agnu basically the Nixon political machine speo agu uh helped find essentially boost a third party at that point a third party candidate a very right-wing a conservative party candidate James Buckley who ends up being the name on the Buckley V valo case and and Buckley takes up the uh John Bolton Ralph winter argument which again I I just want to tell people like this was a radical idea at the time that money in politics isn’t corruption money in politics is constitutionally protected speech like that is really the basis for everything now I I will also add that there’s a second part of this master plan which unfolds in the second half of our series which is about uh the Federalist society and their understanding that they need to implement Powell’s other part of his memo which is about taking over the courts uh and that the switch from renquist and oconor to Roberts and Alo which happened over a very short period of time we’re talking about months here uh in in the in the mid 2000s that was such a fundamental shift when it came to legalizing corruption because let’s remember the renquist court upheld most of the McCain fine gold law upheld it the McCain fine gold law not perfect but it was a reaction to all the corruption of the 1990s John McCain pushed for campaign Finance reform to try to stop uh corporate soft money from flowing to both parties not not only did he shame George Bush into signing it but the Supreme the renquist Supreme Court upheld it so when renquist and oconor flipped to Roberts and delo and the Federalist Society prevented it from being Roberts and Meyers not that Myers would have been necessarily better but certainly might not have been Sam Alo when that switch happened and then one of the first things they did after that switch happened was citizens united uh and citizens united was written by Anthony Kennedy who I think a lot of liberals at the time were telling themselves as you know sort of a moderate swing voter but who had been very very extreme on campaign Finance by the way Anthony Kennedy uh first part of his career as a corporate lobbyist known in Sacramento as the guy who handed out uh uh uh money uh on behalf of his clients all of that was not an accident they had on their mind that we need to deregulate the campaign Finance laws because that unlocks our ability to get all of the other court rulings all of the other political uh uh uh proposals all of the other public policies that we the mass planners AKA corporations and oligarchs that we want because here’s the thing you can’t they understood that in a oneperson one vote democracy they couldn’t get the unpopular self-enriching policies they wanted so but they also understood that they had a disproportionate amount of the society’s money so they had to be able to use the thing that they had the most of money to rig the Democratic process to get what they want so if you want to know why Congress consistently has like a 20 something per approval rating this is your answer right here yeah this is and by the way just you can ask a question in a second I just wanted to point out Tillman Act of 1907 banned corporate political contributions to National campaigns so the idea was let’s not be ridiculous here this is the definition of corruption let’s not do this let’s make it so corporations can’t steer the direction of our politics that’s insane then the politicians will represent the corporations and not the will of the constituents they knew back then this is crazy we’re not going to do that and then since then as you describ David it’s been laware time after time which led to chipping away at this well I I really um I want to dwell on a word you used you described this change of now viewing corporate spending corporate money money in general as speech as a revolutionary idea and I think you mean that very specifically because it it truly it is almost like a a slow-moving coup that they pulled off and I wonder how much in your view this shift in normalizing legalizing you know making effectively the law of the land corruption and money being King over everything how much that is responsible for then you know immediately after that you get the Ronald Reagan Revolution and Bill Clinton coming into office and sort of you know consolidating that from the Democratic side and the neoliberal era which caters to corporate power above all and defers to markets and all decision- making rather than you know the governance and the will of the people how much are these decisions and this revolution responsible for that reigning ideology yeah I look we tell the story in master plan specifically of how the campaign Finance system was deregulated and by the way how the bribery laws were gutted we’re talking about straight up the the anti-c corrupt the I mean there’s corruption there’s like soft corruption I give money to a a candidate and then they do what I want and then there’s like sort of hard corruption like actual bribery like I literally paid someone to to do something and those laws have been gutted as well we tell that story but your point is well taken that that the story We Tell is integral to all of the public policy and political developments of those eras as this is happening right I mean th Ronald Reagan’s deregulatory agenda his tax agenda uh this is benefiting the donor class that is now being allowed to put more and more money into politics to reelect Ronald Reagan uh elect uh Republicans to Congress same thing for the Democrats uh Bill Clinton uh doing Wall Street deregulation G getting rid of glass deagle and the like uh is happening at the same time the Democratic party is Raising more and more money from Wall Street uh Wall Street that that money money isn’t given out of the goodness of wall Street’s heart that money comes with the expectation and demands of legislative favors you can go down the line of every policy every policy that is popular that either has been taken off the books or gutted or every policy that people want that hasn’t been enacted there’s almost always a huge money interest in making sure it doesn’t happen and I’ll add one other point here which is that this gets magnified as you go below the presidential level in my view um it there’s an argument to be that there’s so much money in presidential politics coming from so many different interests uh and that the politicians running for president become so kind of independently famous that they sometimes can feel like it’s sort of liberating right like they can once in a while do things where they’re not just answering to a specific donor BYT of the fact of how well known they are and how famous they are but if you go one level down this is where the real corruption in to my mind where the money politics get ma magnified in a real way the average Congress person who may run a big committee where legislation like they can be the bottleneck on the biggest of big legislation they’re not typically known uh by the country they might even be barely known in their home District uh they really need a lot of money uh to be communicating to get reelected so in a sense the lower in the political system you go potentially the more responsive uh these people uh can be to money because they arguably need it more especially from Big donor sources uh in order to get reelected right there’s this idea that like every candidate could replicate the Bernie Sanders model like that’s the solution to money in politics like you know your state legislator or your city council person can run an expensive campaign uh only raising you know very small amounts of money the problem with that idea though is is that your city council person is never going to be as famous as as Bernie Sanders running for president right you’re never going to have a national small donor uh small donor base to raise enough money to run a competitive election in your city so the so it’s almost like the game is set up to prioritize the big uh sort of corporate interested donors the lower in the in the in the system you go because the candidates running for that office need the resources but can’t develop inherently won’t be able to develop the kind of national fundraising base that they would need to have a small dollar uh uh donor base it’s like the system is designed to to to incentivize the kind of corruption we’re talking about you guys have to check this podcast out I mean this is how your country was effectively stolen from you if you live in the United States this is why they don’t pass legislation on a regular basis that you want in what’s supposed to be a constitutional republic and representative democracy this is how you get a situation where over 90% of the country wants Universal background checks on guns but we don’t get it because the NRA bought one entire political party and they do the bidding of the NRA and not the bidding of the American people or those poor kids who are getting gunned down in schools so can I can I add one one thing because I think it’s important because I think a lot of people will say all right you know I already know this I already know like I already know the system is corrupt now you may not know how it got this corrupt but the certainly polls tell us that people sense and kind of inherently implicitly know how corrupt the system is and and I think there’s a tendency to say oh nothing can be done about this that that actually this isn’t even corruption anymore this is just this is just what politics now is I don’t even know why you guys are talking about it like right and and I I’ve used this before the the David Foster Wallace speech or the famous speech that this that this writer gave where it’s it’s this speech about how there’s two fish swimming along in the water another fish swims by and says hey guys how’s the water and the fish say what’s water and I worry that corruption is becoming like that that we’re that we’re so immersed in it that we think that that that that’s just the way it is that it’s a natural inevitability and nothing can be done that’s not true there are specific things that can be done right now to at least uh deal with some of the worst part parts of this the Congress could pass the disclose act to at least make sure that dark money donations are disclosed so we know who at least is spending the money states can do that cities can do that Congress can pass public financing of Elections states can publicly Finance elections cities can publicly Finance elections and some of them have and that would give candidates who want to run for office a way to run without having to rely on private money that comes with the expectation of legislative favors and the thing is these are not Pie in the Sky ideas Congress almost passed public financing elections a couple times states and cities have done that and I just want to remind people John McCain I mentioned him once John McCain you know I got some disputes with him on a on a lot of things right but John McCaine raised the profile of campaign Finance reform in the middle of a horribly corrupt era the 1990s and actually passed meaningful legislation the point in saying this is this is not a natural inevitability we can actually do something about this and political change can move very fast so I don’t want people to think that they’re listening to this podcast to understand what happened is a way just to feel bad it’s a way to understand the decisions that were made so that we understand that other decisions can be made to make this better yeah there was a revolution so there can be a counterrevolution that’s exactly right so tell everybody where they can find having all of these policy victories it’s like this is a different country on a different planet in a different galaxy in a different universe and it was only 50 years ago which just reiterates my point that like it wasn’t so long ago that it wasn’t perfect but but it wasn’t nearly what it is now which means it doesn’t have to be what it is now yeah we’re going to bring it back we’re going to     Introduction: What is Free Speech Today?

    In a world where political discourse is dominated by big tech, cable news, and social media influencers, free speech is constantly under threat. From censorship of conservative viewpoints to the silencing of dissent on controversial issues, we are witnessing an alarming trend of restrictions on the most fundamental rights of any citizen in our Constitutional Republic: the right to speak freely.

    The Constitutional Perspective: Why Free Speech is Non-Negotiable

    The First Amendment of the United States Constitution is crystal clear: “Congress shall make no law… abridging the freedom of speech.” The Founding Fathers understood the importance of free speech in preserving a free society.     Yet today, under the guise of protecting people from “misinformation” and “hate speech,” powerful institutions are curbing our ability to express ideas that do not conform to their narratives.

    Do we not see this as a slippery slope toward authoritarianism?

    Shouldn’t we, as citizens, be the ones who decide what we can or cannot hear, not a centralized body or corporation?


    Social Media and Cable News: Platforms or Gatekeepers?

    Social media was once hailed as the bastion of free speech. It allowed ordinary individuals to share their thoughts, advocate for causes, and hold the powerful accountable. However, over the years, major platforms like Twitter (now X), Facebook, and YouTube have become gatekeepers rather than facilitators of free expression.

    Algorithms favor certain ideologies, while alternative viewpoints—especially those with a more conservative or constitutional slant—are shadow-banned, demonetized, or outright censored.

    Does this not resemble the tactics of monarchies, communistic or fascist regimes that control what their citizens can see and hear?

    Shouldn’t a true democracy allow the free flow of ideas, even if those ideas challenge the status quo?


    Social Media Influencers: Fighters for Freedom or Puppets of Censorship?

    Many social media influencers, especially those aligned with constitutional values, have become modern-day warriors for free speech. Yet, they face intense backlash, censorship, and de-platforming for voicing opinions that challenge globalist or left-leaning narratives.

    How many times have we seen influential voices banned simply for questioning government policies, election results, or health mandates?

    Isn’t it concerning that only a select group of elites can decide what is “acceptable” discourse?

    While some influencers fall in line with these restrictive policies, others have emerged as champions for free speech, using their platforms to resist censorship and uphold constitutional rights. The question is: Will we support these voices, or will we allow them to be drowned out by corporate and governmental censorship?


    The Dangers of Socialism, Communism, and Fascism: A Threat to Free Speech

    At the heart of socialism, communism, and fascism lies a common tactic—control over speech. These ideologies have historically sought to suppress dissent, limit expression, and create a monolithic narrative that favors those in power.

    Look no further than authoritarian regimes past and present, where dissenters are imprisoned, media is state-controlled, and free speech is criminalized. Can we really ignore the striking similarities between these oppressive ideologies and the current state of political discourse in America?

    Is the suppression of speech today not a precursor to more draconian measures tomorrow?

    Should we not fight to preserve the right to freely express political, social, and economic ideas?
